GLENS FALLS, N.Y. (AP) — An upstate New York man has been convicted of killing his 15-month old son.
The Glens Falls Post-Star reports (http://bit.ly/1b8zj3K ) that 30-year-old Gary Waite was convicted Wednesday of second-degree murder and manslaughter by a Warren County jury.
Jesse Smith died of a head injury after being hospitalized on Feb. 13, 2012.
Waite told investigators the boy fell, wouldn't stop crying and then hit his head when Waite threw him on a couch and he bounced onto the floor.
District Attorney Kate Hogan presented three medical experts who testified the boy's injuries were too severe to have been caused that way.
Waite faces up to 25 years to life in prison. He's scheduled to be sentenced on Dec. 11.
Waite's lawyer says he'll appeal the conviction.
