The Batavia woman sentenced earlier this month to five years behind bars for punching a 70-year-old Walmart greeter in the face won a stay of her prison sentence Friday, court officials said.
Jacquetta Simmons, 27, had already begun serving her sentence at the Bedford Hills Correctional Facility for Women.
Associate Justice Rose H. Sconiers, an appellate court judge, granted the stay in a Buffalo courtroom Friday afternoon.
She ordered Simmons must pay $50,000 in bail to be released while awaiting a decision by the appeals court.
Simmons was arrested Christmas Eve after Grace Suozzi when the Walmart greeter tried to check Simmons’ receipt as she was leaving the store on Veterans Memorial Drive.
