A judge has rejected an appeal of a Toronto court’s earlier dismissal of a civil lawsuit against the controversial, 12-story Crystal Beach Gateway condominium in Fort Erie.
The decision by the Ontario Superior Court of Justice eliminates the last judicial appeal aimed at halting the project. The Ontario Municipal Board received 13 appeals in November 2010 regarding the Bay Beach project, and all were dismissed.
Critics argue Bay Beach high-rise would not fit in with the town’s ambience and cause the surrender of some of the town’s land to the Molinaro Group, the project’s developer. Supporters of the project say the condo would be a boon to the local economy and result in needed beach amenities.
