LOCKPORT – Steven A. Rathke, 54, of Ridge Road, Newfane, was ordered Tuesday by Niagara County Judge Sara Sheldon Farkas to surrender his driver’s license as he pleaded not guilty to an indictment accusing him of driving under the influence of drugs and alcohol Jan. 31 in the Town of Lockport.

Rathke is charged with driving while intoxicated, driving while his ability was impaired by drugs and by a combination of drugs and alcohol, running a stop sign and a lane violation. He refused the breath test, Assistant District Attorney Peter M. Wydysh said.

Rathke was charged with a drug misdemeanor when sheriff’s deputies executed the warrant against him Sunday night, but that topic didn’t come up in court Tuesday. Farkas allowed Rathke to remain free on $1,000 bail.
