WARSAW – A town of Covington man has been charged with the new state criminal offense of aggravated family offense for allegedly continuing to abuse his mother, the Wyoming County Sheriff’s office announce Friday.

The sheriff’s office received a report from the Wyoming County District Attorney’s Office detailing how Timothy J. Foss, 39, of Lemley Road, tore his mother’s telephone from the wall on Feb. 1 as she was attempting to call for help from the home they share.

Under the new law, because Foss had a family offense conviction for abuse against his mother within the past five years, he became the first Wyoming County resident charged with the new felony offense, which is punishable by a prison term of up to four years.

Foss is being held at the Wyoming County Jail with a no-bail court order and facing a Covington Town Court appearance on Monday.
