LOCKPORT - A man who was sentenced a decade ago to five to 15 years in prison on a drug possession charge had his term cut to seven years Monday by Niagara County Judge Sara Sheldon Farkas.
Luis A. Montanez, 48, has been in and out of prison four times because of multiple parole violations, Assistant District Attorney Peter M. Wydysh said.
However, his original sentence was longer than the nine-year maximum for his crime that was part of the state’s revised drug laws passed in 2009.
Montanez’ attorney, Ann Nichols, said Montanez likely will be released soon as a result of Farkas’ decision. She said Montanez has a newborn daughter he wants to take care of, since the mother is now incarcerated on drug charges herself.
