NIAGARA FALLS – A neighbor helped identify a suspect in the burglary early Saturday of the Ray Mart store on Pine Avenue, police said.

Officers arriving just before 3 a.m. discovered the front door to the business shattered and cigars scattered on the sidewalk, with two bags of items sitting on the floor near a door, police said.

The witness, police said, pointed officers to a suspect walking across the street. Johnny D. Marks, 31, of Buffalo was charged with third-degree burglary, third-degree criminal mischief and fourth-degree grand larceny. He also faces a failure to appear warrant issued in City Court, police said.

Police said glass from the shattered door was found in one of Marks’ boots, and electrical service to the store had been disabled. Several lottery tickets were missing, police added.

Police are on the lookout for an accomplice.
