LOCKPORT – A Hartland woman, kicked off probation last week for failure to cooperate with drug counseling, may be headed to jail soon, and Niagara County Judge Sara Sheldon Farkas said a Lockport man may not be far behind.
Farkas scheduled sentencing Dec. 19 for Kelly L. Smith, 49, of Ridge Road, Hartland. She had been on probation since July for selling her prescription painkillers.
In the other case, Assistant Public Defender A. Joseph Catalano talked Farkas into giving Kevin I. Kelly 60 days on interim probation to show he can stop using marijuana. Catalano conceded that Kelly has made no real effort to do so.
“I don’t think he’ll do well [on probation]. I can still send him to prison, but I’ll give it a shot,” Farkas said.
Kelly, 19, of John Street, Lockport, had pleaded guilty to having 1.48 grams of crack cocaine when a car in which he was a passenger was stopped May 22 on Walnut Street in Lockport.
