A Cheektowaga man has been sentenced to 90 days in the Erie County Correctional Facility for the August attack on a woman with whom he lived, town police reported today.
Robert Day, 53, of Preston Road, was sentenced last week by Cheektowaga Town Justice Paul Piotrowski. Day had pleaded guilty to charges stemming from the Aug. 12 assault of his 57-year-old companion.
Police said Day slammed the woman against a wall and then choked her from behind with his forearm, obstructing her breathing. He fled on a bicycle, but was located by officers near Roma Road and East Delevan Avenue and arrested after a struggle.
In sentencing Day, the judge said that a physical assault on a woman will never be overlooked or tolerated by the court, police said. The judge also considered Day’s criminal record, which includes convictions on charges of harassment and driving under the influence of drugs or alcohol, according to public records.
