LOCKPORT – A Niagara Falls man pleaded guilty Thursday to a Leandra’s Law violation for driving drunk with two children in his car, and was ordered to apologize to the arresting officer.

Marlowe J. Smith, 31, of 23rd Street, admitted to aggravated driving while intoxicated and is to be sentenced Jan. 9. He was arrested June 25 in Niagara Falls by a state trooper who measured his blood alcohol content at 0.24 percent, three times the legal threshold for intoxication. Smith’s passengers were his girlfriend’s children, ages 1 and 6.

State Supreme Court Justice Richard C. Kloch Sr. ordered Smith to apologize in open court to the trooper who pulled him over, because the intoxicated Smith had threatened to “get him.” Smith did so. Kloch promised to sentence him to no more than a year in jail.
