LOCKPORT – A judge has dismissed a felony cocaine possession indictment against Stacey Lewis, 29, of Niagara Falls, the Niagara County District Attorney’s Office disclosed Wednesday.

Lockport City Judge William J. Watson, serving as an acting county judge, ruled that the drugs seized in a raid on Lewis’ Elm Court home Sept. 23, 2011, had to be suppressed, because prosecutors could not prove there was probable cause for issuing a search warrant.

Neither the Niagara Falls Police Department nor Niagara Falls City Judge Robert P. Merino, who signed the warrant, preserved any evidence showing the probable cause. Without being able to use the cocaine as evidence, prosecutors were unable to make a case against Lewis.
