LOCKPORT – Duane E. Price, a burglar who was ejected from a court-supervised drug treatment program because he wasn’t really a drug addict, was sentenced to two to four years in state prison Tuesday by Niagara County Judge Sara Sheldon Farkas.
Price, 38, of Lockport-Olcott Road, Newfane, had been placed into the judicial diversion program last December, after pleading guilty to third-degree burglary and first-degree criminal contempt. He was booted in August for violating the rules, even though his drug tests were clean.
“They determined you’re not a drug addict. You’re a criminal,” Farkas told Price, a man with a 22-year criminal record who entered a woman’s home on Orchard Street in Lockport Sept. 20, 2011, 18 days after assaulting her in violation of a restraining order.
