LOCKPORT – Charles R. Hinks II, a Niagara Falls man who is serving 30 months in a federal prison in Pennsylvania for marijuana dealing, was sentenced Monday to a concurrent term of one to three years for violating probation in a statutory rape case.
The drug charge constituted the violation, defense attorney Charles Marchese said.
Hinks, 30, did not appear in Niagara County Court for the sentencing by County Judge Sara Sheldon Farkas. He was placed on 10 years’ probation in 2005 for having sex with a 16-year-old girl in North Tonawanda on Jan. 1, 2005.
Hinks pleaded guilty last fall to a federal charge of conspiracy to distribute marijuana. The plea agreement saw him admit to helping co-defendants break up 30-pound bales of pot into smaller pieces on three occasions in early 2011 in Niagara Falls.
