LOCKPORT – Darius M. Belton of Niagara Falls pleaded not guilty in Niagara County Court today to an indictment charging him with the shooting death of his uncle Sept. 25.
Belton, 18, of South Avenue, is charged with second-degree murder and second-degree criminal possession of a weapon in connection with the death of Luis A. Ubiles, 37, who lived next door to the defendant.
Deputy District Attorney Doreen M. Hoffmann said Ubiles died from a single gunshot wound to the abdomen, just below his chest. The outdoor shooting followed a minor argument between Ubiles and Belton’s mother, Deon Ubiles, who police said is married to Luis Ubiles’ brother.
Accompanied by defense attorney Angelo Musitano, Belton turned himself in at Niagara Falls Police Headquarters Sept. 28 and had been held without bail since. Today, County Judge Sara Sheldon Farkas set bail at $250,000. Hoffmann said Musitano has not been formally retained by Belton, so no further action will be taken until an attorney appearance in court Nov. 2.
