The legal battle isn’t over in Erie County Legislator Betty Jean Grant’s bid for a full recount of the votes in the Sept. 13 Democratic primary in the 63rd State Senate District.
Grant announced that she will appeal this week to U.S. District Court to restart the ballot counting process that was halted two weeks ago by State Supreme Court Justice Joseph Glownia, giving incumbent State Sen. Timothy M. Kennedy a 139-vote victory.
Grant contends that nearly 500 ballots, many from her home base on Buffalo’s East Side, shouldn’t have been rejected due to technicalities. Grant’s supporters say they will launch a write-in campaign for her in the Nov. 6 general election.
