State Sen. Tim Kennedy will be certified the official winner in his primary campaign against Erie County Legislator Betty Jean Grant, Kennedy’s office reported late Friday in citing an order by the State Supreme Court.
The court ordered the Erie County Board of Elections to certify Kennedy the winner of the race for the 63rd District Senate race.
“We’re thrilled the State Supreme Court completed its comprehensive review today and has ruled that it is finally time to certify our victory,” Kennedy said.
“[The] ruling comes just in time. Any further delays could potentially deny local military personnel their right to cast a vote in the upcoming presidential election,” he added. “State law requires that military ballots be sent out this weekend, so I am pleased that our victory will be certified and that the Board of Elections will now be able to print and send ballots to members of the armed forces.”
The final count from the Board of Elections announced last Friday also resulted in Kennedy being declared the winner by a 139 vote margin out of more than 21,000 votes.
Grant was unavailable for comment Friday evening.
