PENDLETON – A 60-year old man was killed Tuesday night when his car hit a pickup truck that was backing into a driveway in the 7200 block of Bear Ridge Road. The driver of the pickup was charged at the scene with driving while intoxicated.
The driver of the pickup, Nathan Morris, 29, of Pendleton was charged with both DWI and having an unregistered trailer.
The driver of the car, Frank A. Penepento Jr., 60, of Lockport was killed when his 2009 Toyota crashed into Morris’ pickup. Penepento was pronounced dead at the scene.
According to the Niagara County Sheriff Department Panepento’s car had been heading northbound just before 10 p.m. Tuesday when his car crashed into Morris’s 2008 pickup as Morris was backing into an acquaintance’s driveway .
After performing field sobriety tests Morris was arrested at the scene.
The crash remains under investigation and further charges are possible, according to the Niagara County Sheriff Department.
