LOCKPORT – Michael D. Agee of Niagara Falls, who is awaiting trial in connection with a pair of armed robberies, was arraigned in Niagara County Court today on a indictment accusing him of shooting a man in a parked car July 14.
Agee, 19, of 16th Street, pleaded not guilty to first-degree assault, second-degree criminal possession of a weapon and second-degree menacing.
Assistant District Attorney Theresa L. Prezioso said Agee allegedly shot Lafayette Lewis, 44, in the forearm as the victim sat in a parked car. Police said it happened in the 700 block of Eighth Street.
Agee was out on bail on an indictment accusing him of robbing a store and a man while carrying a handgun in December 2010. His trial on those counts is now set for Oct. 29, and County Judge Sara Sheldon Farkas ordered Agee held without bail in the meantime.
