NIAGARA FALLS - A South Avenue man is scheduled to return to court Wednesday on charges of second-degree murder for the Sept. 25 shooting death of his uncle.
Darius M. Belton, 18, was arraigned Friday in City Court Friday after being charged with second-degree murder and first-degree criminal use of a firearm in the shooting death of Luis A. Ubiles in front of Belton's home in the 1600 block of South Avenue.
Belton was remanded without bail and is currently being held in the Niagara County Jail.
Belton had been named a person of interest shortly after the shooting. He was arrested following questioning after he turned himself into police with a lawyer on Friday, according to Detective Lt. Michael Trane.
Ubiles, 37, was shot once in the chest and died shortly afterward in Niagara Falls Memorial Medical Center.
Police said they believe Belton and his mother, Deon Ubiles, who was Luis Ubiles' sister-in-law, were arguing with Luis Ubiles when Belton shot him. Trane said Deon Ubiles is the wife of Luis Ubiles' brother and Belton is his nephew.
