LOCKPORT - David L. Starr, 59, of Cedar Avenue, Niagara Falls, was sentenced Monday to a one-year conditional discharge and $216 in restitution in a metal theft case, which led to his guilty plea to fourth-degree criminal mischief.
That was the same penalty Niagara County Judge Sara Sheldon Farkas imposed Thursday on co-defendant Jeremy M. Slattery, 34, of Elmwood Avenue, Niagara Falls, who had admitted to petit larceny.
Assistant District Attorney Joseph A. Scalzo told Farkas that Starr, a former handyman, led Slattery to believe he had permission to be in the Whitney Avenue home, from which a hot water tank and copper pipes were stolen Sept. 20, 2011.
