LOCKPORT - A man who took part in the theft of copper pipes and a hot water tank from a Niagara Falls home last year was granted a conditional discharge Thursday because he's already on probation for failing to pay child support.

Jeremy M. Slattery, 34, of Elmwood Avenue, Niagara Falls, a father of four, has two more years of probation in the Family Court matter. Niagara County Judge Sara Sheldon Farkas ordered him to pay $216 in restitution for the Sept. 20, 2011, theft from the Whitney Avenue home.

Assistant District Attorney Joseph A. Scalzo told Farkas that Slattery was allowed to plead guilty to petit larceny because co-defendant David L. Starr led Slattery to believe he had permission to be in the home. Starr, 59, of Cedar Avenue in the Falls, is awaiting sentencing on his guilty plea to fourth-degree criminal mischief.
