An Akron man was charged with a felony count of drunken driving following a two-car accident Wednesday night in the Town of Newstead, State Police reported this morning.
Thomas J. Lutz, 49, was driving a pickup north on Milgrove Road when he failed to yield to eastbound traffic on Main Road, colliding with another vehicle. Nobody was injured in the accident, which occurred shortly after 9 p.m.
The name of the other driver wasn't released by police .
Lutz, who appeared to be intoxicated, was directed to perform field sobriety tests but refused to submit to a chemical test to determine his blood-alcohol content, troopers said. He was charged with a felony count of DWI because of a prior conviction.
Following arraignment in Newstead Town Court, Lutz was released without bail pending another court appearance on Oct. 10.
