LOCKPORT - A Niagara Falls man who pleaded guilty to having sex with an underage girl asked for a jail sentence Thursday, but was placed on 10 years' probation instead.
Zachary J. Lowman, 21, of 87th Street, who had been in Niagara County Jail, runs the risk of a state prison sentence of up to four years if he violates any of the probation terms. Lowman, who pleaded guilty to a reduced charge of attempted second-degree rape for having sex with a 14-year-old girl Nov. 29, asked for a year in the county jail, most of which he had already served.
Defense attorney Robert Viola told County Judge Sara Sheldon Farkas that Lowman wasn't confident he could follow the rules on probation.
Assistant District Attorney Elizabeth R. Donatello said Lowman had sex with the girl after she came to his home and used synthetic marijuana, which knocked her out temporarily.
