Plea of guilty entered in crash causing injury
Nathan D. Pfaffenbach pleaded guilty to aggravated vehicular assault and drunken driving Wednesday for a crash that injured passengers in the other vehicle as he was being chased by Town of Evans police.
Under a pre-indictment plea deal, Pfaffenbach, 31, of Wabash Avenue, Blasdell, pleaded guilty to causing the injuries suffered by Kyle C. Golden, 43, and his wife, Lea, 38, of Lawtons. The crash occurred in the Town of Brant outside the entrance to Evangola State Park on Route 5 at about 1:30 a. m. June 28.
Prosecutor Kelley A. Omel said the Goldens are still being treated for face and hand injuries, while Pfaffenbach was uninjured.
Omel said Pfaffenbach had a blood alcohol reading of 0.18 percent after the crash, in which his vehicle struck the other vehicle.
State Supreme Court Justice John L. Michalski told Pfaffenbach he will likely cap his possible state prison term at between one to three years and will also consider weekends in jail or straight probation.
He was allowed to remain free without bail pending his March 24 sentencing but was warned he faces up to 15 years in prison if caught driving other than to his alcohol counseling sessions.
