Felony aggravated DWI brings 30 days in jail

LITTLE VALLEY—An Irving man was sentenced to 30 days in Cattaraugus County Jail after being convicted of felony aggravated driving while intoxicated, District Attorney Edward M. Sharkey reported.

James R. Nelms, 34, who lost his license due to a prior alcohol conviction, was arrested Oct. 4, 2008, in Perrysburg, where he was found to have a .23 percent blood alcohol level. He also had cocaine on him, Sharkey said.

Besides the jail sentence, Nelms was sentenced to five years’ probation and fined $2,000.

He was fined $1,000 for being convicted of aggravated unlicensed operation of a vehicle and sentenced to a concurrent three-year term of probation for misdemeanor criminal possession of a controlled substance.
