Aggravated DWI brings prison term of 1 to 3 years
LITTLE VALLEY—A 35-year-old Irving man was sentenced Monday to one to three years in prison for his conviction on a charge of aggravated driving while intoxicated, the Cattaraugus County district attorney’s office reported.
A Cattaraugus County Court judge also ordered Garth Van Every to pay a $3,000 fine and revoked his driver’s license. He had been caught driving with a blood-alcohol level of 0.23 percent— nearly three times the legal limit— on April 13, 2008, in the City of Salamanca.
Also Monday, Terry D. Hunter, 38, of Buffalo, pleaded guilty to a felony count of criminal possession of a controlled substance.
Hunter admitted to possessing more than 500 milligrams of cocaine when he was caught by police June 6, 2007, in Olean. Sentencing is set for Aug. 10.
