- Giana Lynn Bootes, 2, left home Wednesday with her mother's boyfriend and has not yet been returned.
NEWFANE — Niagara County sheriff's deputies this afternoon said they had found a 2-year-old girl who had been reported missing and charged the boyfriend of the girl's mother for keeping the toddler overnight.
The sheriff's office had earlier in the day issued an alert for Giana Lynn Bootes, who left her mother's home at 6285 Bayview Station with her mother's boyfriend, David Michael Figueroa-Oehler, at 5:30 p.m. Wednesday and did not return.
"The mother was not feeling well and her boyfriend . . . offered to help out," said Capt. Scott Lombardo.
Figueroa-Oehler told his girlfriend he was going to get gas and supplies for a new job and would take the toddler with him, but then never returned, Lombardo said.
Figueroa-Oehler and the girl were found at 3 p.m. in the Super 8 Motel on Sheridan Drive in the Town of Tonawanda by town police, Lombardo said.
Niagara County Sheriff's Chief Investigator Bruce Roth said Figueroa-Oehler was charged with endangering the welfare of a child because of the circumstances and time frame in taking the child. He said the boyfriend had no intent to harm the girl and she was returned in good condition.
