Jury convicts driver of assault

A Lisbon Avenue woman was convicted Thursday of driving over a woman twice and attempting it a third time behind a convenience store at Doat and Genesee streets at about 2 a. m. Dec. 28.
Jacqueline Q. Worthy, 36, was found guilty of first-degree assault in the attack on Ebony Martin, 30, of Sweet Avenue. A jury in the courtroom of Erie County Judge Sheila A. DiTullio reached the verdict in about three hours following a trial that lasted a week.
Worthy, however, was found not guilty of attempted second-degree murder. No defense witnesses testified.
The victim, who suffered back injuries and has been unable to return to work as a city parking attendant, testified that she was trying to break up the fight between two men, who had fathered children of the defendant.
Prosecutor Lauren Nash said Worthy sped away in her car after the attack and was arrested about 12 hours later.
Worthy, who had been free on bail, wept as she was remanded following the verdict. She could face up to 25 years in prison but faces at least eight years behind bars because she was convicted of assaulting another woman in 2005.
In closing arguments, Worthy’s attorney, Emily Trott, argued that the attack was an accident, that Worthy could not see Martin as she tried to drive away.
